PokeMail Terms and Conditions

Welcome to PokeMail! These Terms and Conditions ("Terms") govern your use of the PokeMail website, your PokeMail membership or subscription, and any products, mailings, rewards, promotions, or services provided by Cox Signs, LLC, doing business as PokeMail ("PokeMail," "we," "us," or "our").

By creating an account, purchasing a subscription, or otherwise using PokeMail, you agree to these Terms.

1. About PokeMail

PokeMail is a Pokémon-themed snail mail club that sends subscribers fun collectible mailings. Depending on the subscription level and availability, mailings may include items such as:

• Authentic Pokémon trading cards
• Fan-created sticker sheets
• Activity sheets
• Mailable postcards
• Collectible information cards
• 3D-printed figurines, keychains, magnets, or other surprises
• Special birthday-month surprises
• Other Pokémon-themed or collectible items

The exact contents, designs, characters, quantities, colors, and styles may change from mailing to mailing.

Products may vary and are subject to availability.

2. Adult Account Requirement

PokeMail is designed to be fun for children and collectors; however, subscriptions, accounts, and purchases must be created and managed by an individual who is at least 18 years old or the age of legal majority in their jurisdiction.

Parents and legal guardians may purchase a PokeMail subscription for a child and may provide the child's first name, mailing information, preferences, and birth month when necessary to personalize the subscription.

Children should not independently provide payment information or other personal information through the PokeMail website.

By subscribing, you represent that you are legally authorized to make the purchase and, when applicable, to provide information concerning the recipient.

3. Subscription Plans

PokeMail may offer multiple subscription levels or membership options. Each tier may contain different products, quantities, benefits, surprises, or mailing frequencies.

The specific price, billing frequency, shipping charges, and benefits of each subscription will be displayed before checkout.

Subscription benefits are based on the tier in which the subscriber is enrolled at the time the applicable mailing is prepared.

We may add, remove, rename, archive, or modify subscription tiers from time to time. Material changes affecting an active paid subscription will be communicated as required by applicable law.

4. Automatic Renewal and Recurring Billing

Unless specifically identified as a one-time purchase, PokeMail subscriptions automatically renew at the billing frequency displayed during checkout.

By purchasing a recurring PokeMail subscription, you authorize PokeMail and its payment processor to automatically charge your selected payment method for the subscription price, applicable shipping charges, taxes, and any other charges clearly disclosed at checkout.

Your subscription will continue to renew until you cancel it.

The amount and frequency of recurring charges will be clearly displayed before you complete your subscription purchase.

If the price of your subscription changes, we will provide notice before the new price is charged when required by applicable law.

5. Mailing Cycles and Cutoff Dates

PokeMail mailings are prepared and sent in batches.

The website may display a cutoff date for an upcoming mailing batch. Subscribers who join after a cutoff date may be placed into the following mailing cycle.

Mailing and arrival dates are estimates and are not guaranteed.

Once a mailing has entered preparation or fulfillment, changes to the recipient, address, subscription tier, or contents may no longer be possible.

6. Cancellation

You may cancel your subscription at any time to stop future recurring charges.

Online subscribers will be provided with a free online method for canceling their subscription. Where applicable, you may also cancel using the same method through which you originally subscribed.

Cancellation prevents future renewals but does not automatically reverse charges that were properly incurred before cancellation.

If a mailing associated with an already-paid subscription period has entered preparation or fulfillment, that mailing may still be sent.

Except where required by law, payments for mailings that have already entered fulfillment are non-refundable.

After cancellation, you will retain access to any subscriber benefits that specifically continue through the end of the paid subscription period unless otherwise stated.

7. Failed Payments

If we are unable to process your subscription payment, we may attempt to process the payment again or notify you to update your payment method.

PokeMail may pause or cancel a subscription if payment cannot be successfully completed.

A subscriber whose payment is not completed before a mailing cutoff may be moved to a later mailing batch.

8. Shipping and Mailing Addresses

Subscribers are responsible for providing a complete and accurate mailing address.

Please update address changes through your PokeMail account before the applicable mailing cutoff whenever possible.

PokeMail is not responsible for packages that are delayed, returned, or delivered incorrectly because of:

• Incorrect or incomplete addresses supplied by the subscriber
• Failure to update an address before fulfillment
• Postal service errors or delays
• Mail forwarding problems
• Weather or transportation delays
• Theft or loss after confirmed delivery
• Events outside PokeMail's reasonable control

If a mailing is returned to us because of an incorrect or undeliverable address, additional postage may be required before it can be mailed again.

9. Lost or Damaged Mail

While we do our best to package PokeMail items securely, postal mail occasionally becomes delayed, lost, or damaged.

If you believe your PokeMail package has been lost or significantly damaged, Contact Nona.

We may request photographs or other information to help us evaluate a damaged shipment.

Replacement items are subject to availability. When the exact item is unavailable, we may provide a comparable replacement.

Nothing in this section limits rights you may have under applicable consumer protection laws.

10. International Subscribers

PokeMail may offer international shipping to selected countries.

International delivery times vary and may be substantially longer than domestic delivery times.

The subscriber is responsible for any customs charges, duties, import taxes, handling fees, or similar charges imposed by the destination country unless specifically stated otherwise during checkout.

PokeMail cannot guarantee international delivery dates or prevent delays caused by customs authorities or international postal systems.

We reserve the right to discontinue shipping to locations where reliable or lawful delivery is unavailable.

11. Mailing Contents and Product Substitutions

Part of the PokeMail experience is receiving a surprise.

Images shown on our website, social media accounts, advertisements, or subscription pages are examples of the types of products subscribers may receive and do not necessarily represent the exact contents of a particular mailing.

Characters, card sets, card rarities, artwork, colors, sticker designs, figurines, keychains, magnets, activities, postcards, and other items may vary.

If a planned product becomes unavailable, we may substitute another product of similar type or intended value.

Unless specifically stated as guaranteed, receiving a particular Pokémon, character, card, rarity, design, or collectible is not guaranteed.

12. Pokémon Trading Cards

PokeMail intends all Pokémon trading cards represented as authentic to be genuine Pokémon trading cards.

We do not knowingly distribute counterfeit Pokémon trading cards.

Card sets, languages, conditions, rarities, years, and values may vary unless a specific product description states otherwise.

Collectible and trading-card market values fluctuate. Any estimated value, market value, comparison price, or similar information provided by PokeMail is for informational purposes only and is not a guarantee of current or future resale value.

If you believe you have received a card that is not authentic, please contact us so we can review the item.

13. Fan Art and Unofficial Items

Some PokeMail extras may include original fan-created artwork, stickers, activities, 3D-printed items, or other independently created products inspired by Pokémon.

Unless specifically identified as officially licensed merchandise, these items should not be understood to be official or licensed Pokémon merchandise.

Official trading cards or other officially manufactured products included in a PokeMail package remain products of their respective manufacturers.

14. Birthday-Month Gifts

Certain subscription levels may include a special birthday-month surprise for the recipient.

To qualify, the subscriber must provide the requested birthday information before the applicable mailing cutoff and have an eligible active subscription when the birthday mailing is prepared.

Birthday gifts:

• May vary from subscriber to subscriber
• Are subject to availability
• Have no cash value
• Cannot be exchanged for cash
• May not be substituted with another surprise
• Are generally limited to one birthday gift per eligible recipient during a 12-month period

Failure to provide accurate birthday information before the applicable cutoff may result in the birthday surprise being delayed or unavailable.

Accounts that are canceled before the birth month will not be eligible to receive the birthday gift.

15. Promotions, Coupons, Rewards, and Referrals

PokeMail may offer coupon codes, referral rewards, loyalty rewards, promotional pricing, credits, points, or similar benefits.

Unless otherwise stated:

• Promotions cannot be redeemed for cash.
• Promotions may have expiration dates.
• Multiple promotions may not be combinable.
• Rewards have no cash value.
• Rewards may only be used with the account that earned them.
• Fraudulent or abusive referral activity is prohibited.

Creating duplicate, fake, or misleading accounts for the purpose of earning referral or reward benefits may result in cancellation of the rewards or account.

We may modify or discontinue a rewards or referral program, subject to applicable law and any specific terms provided with that program.

16. Returns and Refunds

Because PokeMail packages contain curated, collectible, personalized, and/or surprise products, completed mailings generally cannot be returned simply because the subscriber did not receive a preferred character, card, design, or surprise.

Except where otherwise stated or required by law, subscription payments are non-refundable after the associated mailing has entered fulfillment.

If you receive an incorrect item, materially damaged item, or experience another fulfillment problem, please contact us and we will evaluate the situation.

This policy does not limit any non-waivable rights available under applicable law.

17. Small Parts and Product Safety

PokeMail packages may contain trading cards, stickers, magnets, keychains, 3D-printed objects, collectible pieces, packaging materials, or other small items.

Some products may contain small parts and are not suitable for children under 3 years of age.

Adult supervision is recommended where appropriate.

Products should not be placed in the mouth or used in any manner other than their intended purpose.

18. Website Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account.

You agree to provide accurate and current information and to promptly update information that changes.

Please contact PokeMail if you believe your account has been accessed without authorization.

19. Acceptable Use

You may not use the PokeMail website to:

• Commit fraud or other unlawful activity
• Interfere with the operation or security of the website
• Attempt to access another subscriber's account
• Manipulate referral, rewards, coupon, or promotional systems
• Submit false information
• Copy, scrape, reproduce, or commercially exploit PokeMail-created website content without permission
• Use automated systems in a manner that interferes with normal website operation

We may suspend or terminate accounts involved in fraudulent, abusive, or unlawful activity.

20. Intellectual Property and Pokémon Disclaimer

The PokeMail name, website design, original PokeMail graphics, written materials, subscription materials, and other original content created specifically by PokeMail are owned by or licensed to PokeMail, as applicable.

Pokémon and related character names, images, trademarks, copyrights, and intellectual property belong to their respective owners.

PokeMail is an independently operated fan-oriented subscription service and is not affiliated with, sponsored by, endorsed by, or licensed by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., or their respective affiliates unless expressly stated otherwise.

The inclusion or resale of authentic third-party products does not imply sponsorship or endorsement of PokeMail by the manufacturer or intellectual property owner.

21. Privacy

Your use of PokeMail is also subject to our Privacy Policy.

Information such as names, mailing addresses, payment details, recipient information, birthdays or birth months, and account information will be handled according to our Privacy Policy and applicable law.

Payment-card information may be processed directly by third-party payment processors such as Stripe. PokeMail may not directly store complete payment-card information.

22. Electronic Communications

By creating an account or purchasing a subscription, you agree that transactional communications relating to your purchase or subscription may be delivered electronically.

These communications may include:

• Order confirmations
• Payment receipts
• Renewal information
• Shipping or mailing updates
• Account notices
• Cancellation confirmations
• Important changes affecting your subscription

Marketing communications will be handled separately in accordance with applicable law and any preferences available through your account.

23. Website Availability and Errors

We work to keep product information, prices, availability, and website features accurate, but errors occasionally occur.

We reserve the right to correct typographical errors, pricing errors, product descriptions, technical problems, or other mistakes.

If an error materially affects a completed purchase, we may contact the purchaser and provide an appropriate remedy consistent with applicable law.

We do not guarantee that the website will always be uninterrupted or error-free.

24. Limitation of Liability

To the fullest extent permitted by law, PokeMail and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of PokeMail, its website, or its products.

To the fullest extent permitted by law, PokeMail's total liability relating to a particular subscription purchase will not exceed the amount actually paid to PokeMail for the subscription period giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

25. Events Outside Our Control

PokeMail will not be responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, natural disasters, postal interruptions, carrier disruptions, labor disputes, supply shortages, government actions, emergencies, internet outages, or similar events.

26. Suspension or Termination

We may suspend or terminate an account for fraud, abuse, chargeback abuse, threats, unlawful conduct, manipulation of rewards or referral programs, or material violation of these Terms.

Termination by PokeMail does not eliminate obligations relating to purchases or charges that were validly incurred before termination.

27. Changes to These Terms

We may update these Terms from time to time.

When changes are material, we will provide notice as required by applicable law.

The updated Terms will display a revised "Last Updated" date.

Changes will not retroactively eliminate rights that have already accrued under applicable law.

28. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where another jurisdiction's consumer-protection laws are required to apply.

Nothing in these Terms waives any consumer rights that cannot legally be waived.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.

30. Entire Agreement

These Terms, together with the Privacy Policy, subscription description, pricing disclosed at checkout, and any additional terms applicable to a specific promotion or program, constitute the agreement between you and PokeMail regarding your subscription and use of the service.
